These Terms of Service ("Terms") govern access to and use of the PinTips platform (the "Service"), operated by Undici S.r.l.s., a sole-shareholder company with registered office in Italy, Sole Director Marco Cavanna (the "PinTips" or the "Controller").
Use of the Service implies full acceptance of these Terms.
These Terms constitute a legally binding agreement between PinTips and the user who creates an account on the platform (the "Map Author").
People who access maps in view-only mode, without registering (the "Guests"), do not enter into any contractual relationship with PinTips and use the content at their own risk.
Where the App is localized in multiple languages, the Terms are available in several languages. In case of interpretative conflict, the Italian version prevails.
For the purposes of these Terms:
PinTips is a technology platform that allows Map Authors to create, manage and share digital maps containing tips and points of interest.
The Service is accessible to Guests via direct links, QR codes or similar tools, without the need to register.
PinTips does not guarantee any result in terms of visibility, traffic, commercial success or usefulness of the published content.
PinTips operates solely as a technical platform provider and hosting service for user-generated content.
In particular, PinTips:
Any automatic enrichment features (e.g. geocoding, reverse geocoding, place search, automatic suggestions or artificial intelligence systems) are purely technical and do not constitute approval or validation of the content.
To create maps, an Account must be registered, using email and password or via Sign in with Google.
The Service is intended for users aged 14 or over.
Younger users may use the Service only under the responsibility of a parent or legal guardian, who fully accepts these Terms.
The Map Author warrants that the information provided at registration is truthful and up to date, and is responsible for safeguarding their access credentials.
At registration the Map Author freely chooses a username, which becomes part of the public address (URL) through which their maps are accessible to Guests.
The username is chosen by, and the sole responsibility of, the Map Author. The Map Author warrants that the username (and therefore the resulting public address) is not:
PinTips applies automated filters as a mere technical aid which — given linguistic variability and the evolving nature of language — cannot guarantee that every inappropriate username is caught: the absence of an automatic block does not in any way constitute approval, validation or authorization of the chosen username, and does not relieve the Map Author of their responsibilities.
PinTips reserves the right, at any time and at its sole discretion, to refuse, suspend, change or revoke a username it deems to be in breach of these Terms or otherwise inappropriate, and to make it available again to other users, without any right to compensation. The Map Author holds no ownership or exclusive right over the username.
Use of a username in breach of this section constitutes misuse of the Service under section 7.
The Map Author is solely responsible for the published Content.
In particular, the Map Author warrants that the Content:
PinTips is not required to know or verify local, sector-specific or territorial regulations.
Any breach of local laws (even if lawful in other jurisdictions) constitutes misuse of the Service.
Misuse includes, by way of example and without limitation, any use that:
PinTips does not carry out thematic or moral censorship: explicit, adult or controversial content is allowed as such, provided it is lawful.
PinTips reserves full discretion in assessing misuse.
PinTips may suspend or close the Map Author's Account, even without notice, in case of:
PinTips is not required to provide a detailed reason for the measure.
Content remains the property of the Map Author.
In case of suspension or closure of the Account:
After that period, the Content may be permanently deleted. The different retention periods required by law for fiscal data remain unaffected, as set out in the Privacy Policy.
The Map Author grants PinTips a non-exclusive, free and limited license to:
solely to the extent necessary to deliver the Service.
The Map Author further grants PinTips the right to use extracts, previews or screenshots of the Content for the Service's promotional purposes (e.g. website, presentations, informational materials), without independent commercial exploitation and without transfer to third parties.
Some features of the Service are available through paid plans. Payments are processed through the provider Stripe; PinTips does not directly process full payment-instrument data.
The economic terms, billing frequency and renewal or cancellation conditions are indicated at the time of subscription. Any invoices are issued by the Controller in compliance with applicable tax law.
The Service is provided on a best-effort basis.
PinTips does not guarantee continuity, absence of errors or uninterrupted availability of the Service, and may carry out maintenance or experience interruptions due to technical causes or third-party services.
To the extent permitted by law, PinTips is not liable for:
Use of the Service is at the Map Author's risk.
The Map Author undertakes to indemnify and hold PinTips harmless from any claim, damage, penalty or request made by third parties in connection with the published Content or the use of the Service.
The Service integrates third-party services (e.g. authentication, maps and geocoding, payments, hosting, analytics).
PinTips does not control or guarantee such services, which remain subject to their respective terms. The list of the main providers is set out in the Privacy Policy.
PinTips reserves the right to amend these Terms at any time.
Continued use of the Service after the changes are published constitutes acceptance of them.
These Terms are governed by Italian law.
The Court of Turin has exclusive jurisdiction over any dispute.
