Terms of Service

These Terms of Service ("Terms") govern access to and use of the PinTips platform (the "Service"), operated by Undici S.r.l.s., a sole-shareholder company with registered office in Italy, Sole Director Marco Cavanna (the "PinTips" or the "Controller").

Use of the Service implies full acceptance of these Terms.

1. Scope and acceptance

These Terms constitute a legally binding agreement between PinTips and the user who creates an account on the platform (the "Map Author").

People who access maps in view-only mode, without registering (the "Guests"), do not enter into any contractual relationship with PinTips and use the content at their own risk.

Where the App is localized in multiple languages, the Terms are available in several languages. In case of interpretative conflict, the Italian version prevails.

2. Definitions

For the purposes of these Terms:

  • PinTips: the digital platform for creating and sharing interactive maps.
  • Service: the set of features offered by PinTips.
  • Account: the personal profile created by the Map Author.
  • Map Author: any person who creates, manages and publishes maps through the Service.
  • Map: an interactive map created through PinTips.
  • Pin: any point of interest added to a Map.
  • Content: maps, pins, text, images, descriptions and any other material uploaded by the Map Author.
  • Guest: a person who views maps without registering.
  • Misuse: any use of the Service contrary to these Terms, to applicable law, or that exposes PinTips to legal or reputational risk.

3. Description of the Service

PinTips is a technology platform that allows Map Authors to create, manage and share digital maps containing tips and points of interest.

The Service is accessible to Guests via direct links, QR codes or similar tools, without the need to register.

PinTips does not guarantee any result in terms of visibility, traffic, commercial success or usefulness of the published content.

4. PinTips' role and platform neutrality

PinTips operates solely as a technical platform provider and hosting service for user-generated content.

In particular, PinTips:

  • does not create map content;
  • does not review, control or validate uploaded content;
  • does not guarantee the accuracy, completeness or lawfulness of content;
  • exercises no editorial function.

Any automatic enrichment features (e.g. geocoding, reverse geocoding, place search, automatic suggestions or artificial intelligence systems) are purely technical and do not constitute approval or validation of the content.

5. Account and age requirements

To create maps, an Account must be registered, using email and password or via Sign in with Google.

The Service is intended for users aged 14 or over.
Younger users may use the Service only under the responsibility of a parent or legal guardian, who fully accepts these Terms.

The Map Author warrants that the information provided at registration is truthful and up to date, and is responsible for safeguarding their access credentials.

5.1 Username and public address

At registration the Map Author freely chooses a username, which becomes part of the public address (URL) through which their maps are accessible to Guests.

The username is chosen by, and the sole responsibility of, the Map Author. The Map Author warrants that the username (and therefore the resulting public address) is not:

  • offensive, vulgar, obscene, violent, discriminatory or hateful;
  • infringing on third-party rights, including trademarks, distinctive signs, names or personality rights;
  • misleading or liable to suggest ownership, affiliation or sponsorship by PinTips, its operators or any third party (impersonation).

PinTips applies automated filters as a mere technical aid which — given linguistic variability and the evolving nature of language — cannot guarantee that every inappropriate username is caught: the absence of an automatic block does not in any way constitute approval, validation or authorization of the chosen username, and does not relieve the Map Author of their responsibilities.

PinTips reserves the right, at any time and at its sole discretion, to refuse, suspend, change or revoke a username it deems to be in breach of these Terms or otherwise inappropriate, and to make it available again to other users, without any right to compensation. The Map Author holds no ownership or exclusive right over the username.

Use of a username in breach of this section constitutes misuse of the Service under section 7.

6. Map Author obligations and responsibilities

The Map Author is solely responsible for the published Content.

In particular, the Map Author warrants that the Content:

  • is lawful;
  • does not infringe third-party rights;
  • complies with the laws and regulations of the place the map refers to, as well as of the Map Author's country of residence.

PinTips is not required to know or verify local, sector-specific or territorial regulations.

Any breach of local laws (even if lawful in other jurisdictions) constitutes misuse of the Service.

7. Misuse of the Service

Misuse includes, by way of example and without limitation, any use that:

  • breaches applicable laws or regulations;
  • infringes third-party rights;
  • contains false, misleading or harmful information;
  • uses a username (and therefore a public address) that is offensive, discriminatory, obscene, misleading, infringing on third-party rights or liable to impersonate PinTips, its operators or any third party (section 5.1);
  • exposes PinTips to legal or reputational risk;
  • involves technical abuse or anomalous use of the Service.

PinTips does not carry out thematic or moral censorship: explicit, adult or controversial content is allowed as such, provided it is lawful.

PinTips reserves full discretion in assessing misuse.

8. Suspension and closure of the Account

PinTips may suspend or close the Map Author's Account, even without notice, in case of:

  • misuse of the Service;
  • breach of the Terms;
  • breach of law;
  • non-payment of any paid services.

PinTips is not required to provide a detailed reason for the measure.

9. Content, accessibility and retention

Content remains the property of the Map Author.

In case of suspension or closure of the Account:

  • the Content will no longer be accessible to Guests;
  • PinTips may retain it for technical purposes for a maximum of 60 days;
  • PinTips does not guarantee recovery of the Content.

After that period, the Content may be permanently deleted. The different retention periods required by law for fiscal data remain unaffected, as set out in the Privacy Policy.

10. Content license

10.1 Technical license

The Map Author grants PinTips a non-exclusive, free and limited license to:

  • host;
  • reproduce;
  • technically adapt;
  • distribute the Content,

solely to the extent necessary to deliver the Service.

10.2 Limited promotional license

The Map Author further grants PinTips the right to use extracts, previews or screenshots of the Content for the Service's promotional purposes (e.g. website, presentations, informational materials), without independent commercial exploitation and without transfer to third parties.

11. Paid plans and billing

Some features of the Service are available through paid plans. Payments are processed through the provider Stripe; PinTips does not directly process full payment-instrument data.

The economic terms, billing frequency and renewal or cancellation conditions are indicated at the time of subscription. Any invoices are issued by the Controller in compliance with applicable tax law.

12. Service availability

The Service is provided on a best-effort basis.

PinTips does not guarantee continuity, absence of errors or uninterrupted availability of the Service, and may carry out maintenance or experience interruptions due to technical causes or third-party services.

13. Limitation of liability

To the extent permitted by law, PinTips is not liable for:

  • loss of data or Content;
  • inaccuracy of the Content;
  • indirect or consequential damages;
  • decisions or actions taken by Guests on the basis of the Content.

Use of the Service is at the Map Author's risk.

14. Indemnification

The Map Author undertakes to indemnify and hold PinTips harmless from any claim, damage, penalty or request made by third parties in connection with the published Content or the use of the Service.

15. Third-party services

The Service integrates third-party services (e.g. authentication, maps and geocoding, payments, hosting, analytics).
PinTips does not control or guarantee such services, which remain subject to their respective terms. The list of the main providers is set out in the Privacy Policy.

16. Changes to the Terms

PinTips reserves the right to amend these Terms at any time.
Continued use of the Service after the changes are published constitutes acceptance of them.

17. Governing law and jurisdiction

These Terms are governed by Italian law.
The Court of Turin has exclusive jurisdiction over any dispute.
